if 3 or Nokia will give me a replacement, since this is obviously a
flaw in their design (make a phone which will require constant
battery swapping, then make the clips on the battery weak and
flimsy)... it should still be under warranty.
I just don't want to have to give another MNO a phone call

BluTack for the time being? Cheap and nasty solution, but should work. It's something I've had to do with an mp3 player and GPS unit in the past!
